1. Who We Are
KEEPitALIVE is an uptime, workflow monitoring, incident tracking, notification, status page, and automation service operated by Pedro Salabert, an individual based in Portugal.
Contact: support@keepitalive.dev
These Terms govern your access to and use of KEEPitALIVE, including the website, app, API, monitors, checks, notifications, public status pages, triggers, and related services.
2. Acceptance and Eligibility
By creating an account, signing in, or using KEEPitALIVE, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service. If you use KEEPitALIVE on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
You must be at least 16 years old in the EEA or at least 13 years old elsewhere, unless a higher minimum age applies in your country. You may not use KEEPitALIVE if you are legally prohibited from using the service.
3. Accounts and OAuth Sign-In
We may suspend or terminate accounts that violate these Terms, create security risk, abuse the service, or expose us or other users to legal risk.
- Keep your OAuth provider account secure.
- Ensure your account information is accurate.
- You are responsible for all activity under your account.
- Revoke sessions or delete your account if you believe it has been compromised.
4. The Service
Features may change over time. We may add, remove, limit, pause, or modify features as needed to operate, secure, or improve the service.
- Website, API, browser, DNS, ping, TCP, heartbeat, event receiver, and game server monitoring.
- Incident creation and history.
- Notifications through configured channels.
- Public monitors and public status pages.
- Webhook and HTTP automation triggers.
- Monitor sharing and subscriptions.
- Account deletion and session management.
5. No Emergency or Safety-Critical Use
KEEPitALIVE is not designed for emergency services, medical systems, life safety systems, critical infrastructure, regulated healthcare operations, or any use where failure could cause death, personal injury, severe property damage, or legally regulated safety consequences.
You must not rely on KEEPitALIVE as the sole monitoring, alerting, or incident response system for critical systems.
6. No Guaranteed Uptime or Alert Delivery
Unless we separately agree in writing, KEEPitALIVE is provided without any service level agreement.
Monitoring results, alerts, notifications, triggers, browser checks, DNS checks, game server checks, heartbeats, and status pages are provided on a best-effort basis. They may be delayed, incorrect, missed, duplicated, unavailable, rate-limited, or interrupted.
You are responsible for validating that monitors, notification channels, and triggers are configured correctly and for maintaining backup monitoring or alerting where needed.
7. User Content and Acceptable Use
You remain responsible for the monitors, URLs, hostnames, webhook URLs, headers, payloads, secrets, status pages, comments, names, descriptions, and other content or configuration you submit. You confirm that you have the rights and permissions needed to monitor targets, receive events, publish status pages, and execute triggers you configure.
You grant KEEPitALIVE a limited right to process your content and configuration solely to provide, secure, and improve the service.
- Do not attack, scan, overload, disrupt, or abuse networks, systems, or services.
- Do not monitor targets without authorization where doing so is unlawful or abusive.
- Do not send spam, phishing, malware, harmful payloads, or deceptive content.
- Do not exfiltrate secrets or personal data.
- Do not bypass rate limits, quotas, authentication, or security controls.
- Do not use triggers to attack or overload third-party systems.
- Do not upload or publish unlawful, harmful, infringing, or abusive content.
- Do not interfere with the service or other users.
- Do not resell the service without permission.
8. Public Status Pages and Triggers
If you publish a public monitor or status page, you are responsible for its content and for ensuring it does not disclose confidential, unlawful, misleading, or personal information.
Triggers can make outbound HTTP requests or webhooks to systems you configure. You are responsible for confirming that target endpoints are yours or that you have permission to call them, testing trigger behavior before relying on it, protecting signing secrets and webhook URLs, and ensuring triggers do not cause unlawful, harmful, unsafe, or excessive actions.
KEEPitALIVE is not responsible for actions taken by systems you connect to triggers.
9. Plans, Limits, and Billing
KEEPitALIVE may offer free and paid plans. Plan limits may include monitor counts, intervals, history retention, browser checks, trigger usage, notification channels, status pages, sharing, API usage, and other resources.
Paid plans are billed through Stripe. Stripe processes payment methods, subscription renewals, invoices, receipts, taxes where applicable, and access to the billing portal. KEEPitALIVE does not store full payment card numbers.
By starting a paid plan, you authorize Stripe to charge the payment method you provide for recurring subscription fees, applicable taxes, and any plan changes you request. Unless stated otherwise at checkout, subscriptions renew automatically until cancelled.
You can cancel a paid plan through the billing portal or account settings where available. Cancellation normally takes effect at the end of the current billing period unless the checkout or billing portal states otherwise.
Fees already paid are non-refundable except where required by law or explicitly stated by KEEPitALIVE. Separately, we may consider goodwill refunds for a first subscription charge requested within 14 days of payment if the account has not substantially used the paid service. Goodwill refunds are discretionary and do not create an ongoing right to refunds for renewals, partial billing periods, or accounts that have substantially used paid features.
We may change free plan limits or paid plan terms prospectively. We will provide notice where required.
10. Account Deletion
You may delete your account from Account Settings. Account deletion schedules your account for deletion with a 30-day grace period. During the grace period, your account is inaccessible and sessions are revoked. Signing in again during the grace period may reactivate the account.
During the grace period, monitors owned by the deleted account may be deactivated so checks stop running. If you reactivate the account, you may need to manually re-enable monitors, alerts, triggers, or related configuration.
After the grace period, account data is permanently deleted according to our deletion process, except for limited data we are legally required or permitted to keep.
11. Intellectual Property and Feedback
KEEPitALIVE, including its software, design, branding, documentation, and service components, is owned by us or our licensors. These Terms do not give you ownership of KEEPitALIVE.
You keep ownership of the content and configuration you submit. If you send suggestions, ideas, bug reports, or feedback, we may use them without restriction or compensation to you.
12. Third-Party Services
KEEPitALIVE integrates with third-party services such as OAuth providers, notification platforms, hosting providers, email providers, push notification services, and systems you configure. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, outages, changes, errors, or data handling outside our control.
13. Disclaimers
To the maximum extent permitted by law, KEEPitALIVE is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.
We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, security, and error-free operation. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
14. Limitation of Liability
To the maximum extent permitted by law, KEEPitALIVE and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunity, customers, production, or business interruption.
To the maximum extent permitted by law, our total liability for any claim related to KEEPitALIVE will be limited to the greater of the amount you paid to KEEPitALIVE in the 12 months before the event giving rise to the claim or EUR 50.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, intentional misconduct, or liability that applicable law does not permit us to limit.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold KEEPitALIVE and its operator harmless from claims, damages, losses, liabilities, costs, and expenses arising from your use of the service, your monitors, targets, triggers, public status pages, configuration, violation of these Terms, violation of law or third-party rights, or systems or services you connect to KEEPitALIVE.
16. Suspension, Changes, Governing Law, and Contact
We may suspend or terminate access if you violate these Terms, your usage creates security, legal, operational, or abuse risk, required by law, or the service is discontinued. You may stop using the service or delete your account at any time.
We may update these Terms from time to time. Material changes will be posted with an updated Last updated date. Continued use after changes become effective means you accept the updated Terms.
These Terms are governed by the laws of Portugal, except where mandatory consumer protection laws in your country provide otherwise. Courts in Portugal will have jurisdiction, except where applicable law gives you rights to bring claims elsewhere.
